General Terms and Conditions

1. General / Applicability

By using the Yogi & Yousef website and/or placing an order, the Buyer accepts these General Terms and Conditions, as well as all other rights and obligations stated on the website.

In addition to these General Terms and Conditions, Additional Terms and Conditions may apply to certain services and/or products where explicitly indicated. In the event of any discrepancy between the Additional Terms and Conditions and these General Terms and Conditions, the provisions of the Additional Terms and Conditions shall, in principle, prevail, unless otherwise stipulated.

These General Terms and Conditions may only be deviated from if expressly agreed upon in writing, in which case all other provisions of these Terms and Conditions shall remain in full force and effect.

If the Buyer refers to their own General Terms and Conditions, those terms shall not apply unless Yogi & Yousef has expressly agreed to them in writing.

"Buyer" means any natural person or legal entity that places an order through our webshop.

2. Offers and Formation of Agreements

All offers made by Yogi & Yousef are non-binding. Our prices are to be regarded as quotations and as an invitation to potential Buyers to make an offer. Yogi & Yousef is in no way bound by these unless this has been recorded in writing and unambiguously.

The potential Buyer's acceptance of the invitation to make an offer constitutes an offer and only results in the formation of an agreement if the other provisions of this article have been satisfied.

Offers are subject to product availability. Yogi & Yousef has the right to supply a similar product instead of the product ordered or to terminate the agreement.

3. Prices, Delivery and Order Costs

All prices are stated in euros, in accordance with applicable legal requirements, and include VAT and other government-imposed charges, but exclude delivery and order costs, unless otherwise stated in the information relating to the product.

Any special offers are valid only for the period specified in the relevant offer. Delivery and order costs are stated separately when placing an order.

All prices on the website are subject to printing and typographical errors. No liability is accepted for the consequences of such errors.

4. Payment

Orders placed through the website may be paid for using the payment methods stated on the website.

Alternative payment methods and payment terms may only be agreed upon in writing, subject to the terms and conditions to be determined and agreed upon at that time.

5. Discount Codes

Yogi & Yousef discount codes may not be used by the Buyer for their own commercial purposes and/or for purposes other than those for which they were issued.

The Buyer is not permitted to share personal discount codes.

6. Fraud or Other Unauthorised Actions

Any fraud, attempted fraud, or other unauthorised actions will be recorded and will result in the Buyer being prohibited from using discount codes.

7. Delivery and Delivery Times

Orders will, of course, be delivered as quickly as possible. Delivery times stated on the website are indicative only and shall never be regarded as strict deadlines.

Yogi & Yousef may provide additional information regarding delivery times on the website or communicate such information in writing by other means. Such information is indicative only.

Deliveries will be made to the address provided by the Buyer when entering into the agreement. Yogi & Yousef is entitled to fulfil deliveries in separate instalments. Any additional costs associated with subsequent deliveries will be borne by Yogi & Yousef.

Delivery is available to all European countries listed as an option during the checkout process. Our prices and any promotions apply only to these deliveries.

If the delivery address is located outside the Netherlands, Yogi & Yousef reserves the right to cancel such orders.

8. Complaints & Defects / Exchanges & Right of Withdrawal

Defects

Complaints regarding defects in products must be submitted as soon as possible, but no later than 2 days after delivery.

Complaints must be addressed to Yogi & Yousef by sending an email to info@yogiyousef.com.

If the delivered product does not conform to the agreement, Yogi & Yousef shall, at its discretion, only be obliged to provide an appropriate solution.

Withdrawal

You have the right to cancel your order without giving any reason for up to 14 days after receipt. After cancellation, you have an additional 14 days to return your product. Reimbursement will be made within 14 days.

If the product is damaged or the packaging has been damaged beyond what is necessary to inspect or try the product, we may charge you for the resulting reduction in the product's value. Please therefore handle the product with care and ensure that it is properly packaged when returned.

Products cannot be returned if the seal has been broken. Returned goods that are subject to refrigerated storage instructions must be kept refrigerated from the time they are received until they are returned.

You are responsible for the costs of returning the item. We do not accept returns without sufficient postage. Any costs arising from such shipments will therefore be borne by the sender.

9. Retention of Title

Ownership of products, notwithstanding their actual delivery, shall not pass to the Buyer until the Buyer has fully paid all amounts owed to Yogi & Yousef under any agreement, including interest and costs, as well as amounts relating to earlier or subsequent deliveries and any work performed or to be performed in relation to the products.

Before ownership has passed to the Buyer, the Buyer may not encumber, sell, resupply, dispose of, or otherwise transfer the products.

10. Liability

Yogi & Yousef may only be held liable for damage attributable to intent or gross negligence on its part, or arising from circumstances for which it is liable under mandatory provisions of law.

Yogi & Yousef shall never be liable for consequential or business losses, indirect damage, or loss of profit or turnover.

If Yogi & Yousef is, for any reason, obliged to compensate for any damage, the compensation shall never exceed an amount equal to the invoice value of the product or service that caused the damage.

Yogi & Yousef shall never be obliged to compensate for damage other than property damage and/or personal injury.

Yogi & Yousef is not liable for illness or death of pets in the case of postal orders where a pet is able to access and consume the packaged products.

Yogi & Yousef bears the risk of damage to and loss of products during shipment to the Buyer until they have been received by the Buyer.

The provisions of this article do not affect Yogi & Yousef's statutory liability under mandatory provisions of law.

The Buyer is obliged to indemnify Yogi & Yousef against any claims made by third parties in connection with the performance of the agreement, insofar as the law permits the relevant damage and costs to be borne by the Buyer.

Yogi & Yousef may include links on its website to other websites that may be interesting or informative to visitors. Such links are provided for informational purposes only. Yogi & Yousef is not responsible for the content of the linked website or for the use that may be made of it.

The provisions of this article do not affect Yogi & Yousef's statutory liability under mandatory provisions of law.

11. Force Majeure

In the event of force majeure, Yogi & Yousef shall not be obliged to fulfil its obligations towards the Buyer, or such obligations shall be suspended for the duration of the force majeure event.

Force majeure means any circumstance beyond Yogi & Yousef's control that wholly or partially prevents it from fulfilling its obligations towards the Buyer.

Such circumstances include, but are not limited to, strikes, fire, operational disruptions, power failures, failure or delayed delivery by suppliers or other engaged third parties, and the absence of any permit required from government authorities.

Force majeure also includes disruptions to transport or telecommunications networks or connections, communication systems used, and/or the website being unavailable at any time.

12. Privacy Policy

When an order is placed, data is stored in Yogi & Yousef's personal data records. Yogi & Yousef will not provide information to third parties without lawful grounds or outside the purpose of its personal data records where doing so could compromise the customer's privacy.

Your Rights

Under applicable Dutch and European legislation, you, as a data subject, have certain rights regarding personal data processed by us or on our behalf. Below, we explain these rights and how you can exercise them.

As a general rule, and in order to prevent misuse, we only send copies of your data to the email address already known to us. If you wish to receive the information at another email address or, for example, by post, we will ask you to provide proof of identity.

We keep records of requests that have been processed. In the case of a request to be forgotten, we retain anonymised administrative data. All copies of your data will be provided in the machine-readable data format used within our systems.

You have the right at any time to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you suspect that we are using your personal data incorrectly.

Right of Access

If your request is granted, we will send a copy of all relevant data to the email address known to us, together with an overview of the processors that hold this data and the categories under which we have stored it.

Right to Rectification

You may submit such a request to our contact person for privacy matters. You will receive a response to your request within 30 days.

If your request is granted, we will send confirmation to the email address known to us that the data has been corrected.

Right to Restriction of Processing

You have the right at any time to restrict the processing of data that we process, or have processed on our behalf, that relates to you or can be traced back to you.

You may submit such a request to our contact person for privacy matters. You will receive a response to your request within 30 days.

If your request is granted, we will send confirmation to the email address known to us that the data will no longer be processed until you lift the restriction.

Right to Data Portability

You have the right at any time to have data that we process, or have processed on our behalf, that relates to you or can be traced back to you processed by another party.

You may submit such a request to our contact person for privacy matters. You will receive a response to your request within 30 days.

If your request is granted, we will send copies of all data relating to you that we have processed, or that has been processed on our behalf by other processors or third parties, to the email address known to us.
